I think the nightwings should be granted land to live in that can support them and self rule. If a people can’t be given a land, they will take it.
Sorry for the triple post but also wouldn’t it be fair that a nightwing female have a duel with Gliry. If nightwing win, they Get part of the forest. If they lose, they bow to Glory. This fight is pure skill with claws/ a sword, no camo, Fire, venom, mindeead, or foresiGht
It doesn't matter that RainWing abilities may seem overpowered from a subjective real-life perspective. Some tribes are just better than others at fighting, and restricting what they can and cannot do is neither fair nor honorable. Neither is invading someone's home.
Anyhow, my original question was if you disagree that to live in the Rainforest, the NightWings must listen to Glory because she is the queen of the Rainforest. Are you suggesting that the NightWings shouldn't listen to Glory and instead drive them out?^^ I think this was an error of wording on my part, I should have said an 'honest' fight instead of an 'honourable' one
Mastermind is obligated to do everything in his power to make life easier for his subjects and keep them from dying, because
1. He is supposed to test their abilities, not let them starve to death
2. It would be easy to request proper food and water to be given to the Rainwings
3. Basic moral decency
Mastermind has committed criminally negligent homicide as per the definition given in the link.

Because he has committed crimes against Rainwing subjects(the crimes here are crimes under Rainwing law) without the Rainwing queens approving(or even knowing) of it.
Another way you can think of this is victor's law: Glory has won against the Nightwings and is now free to decide Mastermind's fate.
Also, while Mastermind did not hate the Rainwings or had malicious intent towards them, his actions are still despicable. Additionally, the "just following orders" defense is not a good one. Finally, the Nightwing government could have settled things with Rainwings peacefully and gotten the Rainforest peacefully, but decided to wage a secret, undeclared war agianst the Rainwings. The actions of the Nightwing government are probably illegal and definitely immoral to other tribes, and so are its laws. Thus any defense using Nightwing law does not hold water in my opinion.

99%Â of all Nightwings dont have mindreading or foresight so it isnt fair to Glory. Also the Rainwings do not think that any violent challenge for the throne is fair or legitimate. Glory tried to fight for the throne but was forced to do the 5 part challenge

Except that they can't take it. The NightWings are disorganized and greatly outnumbered, while the RainWings have OP powers. If the only reason the RainWings should give free land to an independent NightWing tribe is to prevent them from invading the RainWings, then they shouldn't bother—that'll never happen.

Why should Glory accept this challenge?
It would be unfair to prevent dragons to use their natural weapons. Even animus dragons can use their magic, so why shouldn't a RainWings be able to use venom and camoflage?
Also, if Glory (hypothetically) did, and lost, the NightWings gained their independence; now who will rule the RainWings?

This isn't about Mastermind. This is about whether the RainWings were obliged to save the NightWings.
It wasn't negligence that killed the RainWing test subjects; it was total disregard for their wellbeing because in the Night Kingdom, they RainWings were worthless.
Without a queen or a kingdom, the NightWings are incapable of doing so no matter what.
Not only do you think that Mastermind should be tortured, he should also be killed? What does that achieve?

He was not a subject of the Rainforest Kingdom at the time; therefore, any of Mastermind's actions at the time should not be accountable to RainWing law.
Glory can do as she likes; but that doesn't make it right.
An action being "despicable" isn't enough to justify legal punishment.

Mastermind is an amoral, intelligent sociopath. He is too dangerous to be free.
I disagree. Heavily. Letting their tormentor, the one who let Orangutan starve to death, walk free is a slap in the face for all of his survivors. It is a casual and insulting dismissal of the suffering these innocent civilians have endured.
Those were crimes in the point of view of the Rainwing prisoners. Also, since the Rainwing queens did not know or approve of it at the time, they were utterly incapable of recognising the legitimacy of Nightwing law on this matter. Also, Mastermind was not accountable because he could not be physically forced to account for his crimes. See Warmbier v. DPRK. The actions of the North Koreans involved in Otto Warmbier's detention and suspicious death were regarded as accountable to US law(or more accurately the law of civilised nations).
Mastermind's actions were also not right.
The purpose of law is to prevent or deter people from doing what society agrees is obviously despicable or morally wrong, and which harms others.
The law cannot absolve guilt simply because the person who is given the order fears death/punishment from superiors. We cannot excuse wanton torture or murder because the torturer/murderer was under the compulsion of superiors to do so. If we accept the "just following orders" defense, we can then justify any and all war crimes/crimes against humanity(dragonkind?) based on the self-interest(of not wanting to die) of the perpetrator.
Using this reasoning, victor's law is ok. Also, it is not about international law here; it is the precedent set by the other tribes recognising the actions of the Nightwing government as illegal, immoral, and not legitimate.
